FLEX FITNESS 條款及細則

  這些所有的條款細則（以下簡稱“條款和細則”）約束於 FLEX FITNESS (菲力斯體育會，菲力斯健身會，菲力斯健美運動協會， 設施的到訪和使用，任何人（申請人，會員，訂戶或其他人）向 FLEX FITNESS 完成並提交申請，訂閱，入會，到訪或使用任何FLEX FITNESS 的設施，均視為已接受並同意遵守且受其條款和細則約束。

• 所有報名的會籍不能退款，不能換其他服務，或不能轉讓給其他人。

•   FLEX FITNESS 的政策規定，只有被      FLEX FITNESS 特別聘用為私人教練、教練、講師的身份才能允許進行任何類型的個人培訓，指導。這包括一對一、夥伴、小組等。
• 任何目前未被 FLEX      FITNESS 聘為私人教練、培訓師、教練的身份，如被發現向設施內的其他人員提供未經授權的個人培訓，指導服務，其會員資格將被暫停或給予警告。

• 為他人提供頻繁的設備選擇和調整。
• 為他人編寫或設計運動內容規劃。
• 經常為他人解釋和提供鍛煉技巧或糾正。
• 在設施周圍引導或跟隨他人，並告訴他/她要進行哪些練習或如何進行。
• 因幫助他人進行鍛煉而獲得任何形式的補償或個人收益。

• FLEX FITNESS 無法充分控制來自非 FLEX FITNESS 的個人培訓/指導的質量，這些人可能沒有足夠的學術背景、能力、培訓或經驗來正確培訓客戶，這可能會使設施參與者面臨受傷的風險。 
• 未受 FLEX FITNESS 僱用的人士未接受過工作人員關於設施政策、規則、指南、程序或標準的培訓，因此是未經授權的培訓師。


•   每位會員到達後必須在前台接待處用手機會員APP登錄。
• 每次登錄都必須出示個人的手機會員APP登錄, 如忘記攜帶, 可以出示身份證,      車牌證件或護照等證件進入健身房。
• 你是不允許把會員卡借給他人使用，如有發現，本會必定作出警告。如有再犯，本會保留最終權利取消閣下的會籍，並不會作出退款。
• 使用本會設備需要有效的會籍。過期需要續會。
• 我們建議提前3-7天員工當值時間內續會, 因為如果過期了在非員工當值時間就不能進入。
• 我們員工當值時間是早上8點至晚上11點59分，如要續會請在員工當值時間內。
• 所有 FLEX 會員必須使用      GYM MASTER 藍牙 CHECK-IN進入
• 只能會員本人使用場地，如果帶了非會員進入場地，我們會直接取消會籍。
• 會籍只能會員本人使用，不能外借，如有發現會直接取消會籍。

• 為了個人衛生和保障其他會員使用本會設施, FLEX 需要你攜帶你的個人毛巾。進行任何鍛鍊時, 請穿著合適的運動服裝, 不能穿著拖鞋或露趾鞋.

•  所有未成年人士需要父母或監護人簽署一份會籍同意書才能登記會籍。
• 未成年人士年齡定義為 17歲以下: 父母，監護人簽署並付款後,在沒有父母或監護人的陪同下, 未成年會員可使用本會設施。
• FLEX FITNESS 保留其權利要求父母，監護人陪同其未成年人士。

• 所有會員放棄並免除 菲力斯體育會，菲力斯健身會，菲力斯健美運動協會、其繼任者、會長、副會長、員工和代理人免受以下簽署人可能因任何傷害而向他們提出的所有索賠要求或索賠或死亡，並特此永遠免除 菲力斯體育會，菲力斯健身會，菲力斯健美運動協會及其繼任者、會長、副會長、員工和代理人的所有索賠、要求、傷害、損害、訴訟、損失和責任花費。
• 存在與身體健康和舉重訓練相關的自然危害和風險，會員應對所有此類危害和風險及其所有後果承擔全部責任；
• 運動或使用健身器材不當或超出身體和精神極限和/或涉及健身器材的事故可能導致嚴重傷害甚至死亡； 和
• 由於 FLEX 設施以自助方式運作（晚上12 點至早上 8 點），並且通常在沒有任何現場工作人員的情況下開放，因此會員應始終對自己以及其他會員的安全和福祉承擔全部責任。

•   只有預付正價會籍（三、六、十二個月）可使用暫停會籍。 其他優惠會籍 (任何形式的折扣或優惠價格，非正價) 將不會獲得於場所暫停開放的日子之延長會籍時間。
• 須經 FLEX FITNESS 自行決定批准。
• 會員在下列情況下可以暫停會籍：
• 短期、假期或假期離開澳門（需提供航班行程證明）
• 預付正價 3 個月會員會籍– 一次暫停，最多 7 天。
• 預付正價 6 個月會員會籍– 一次暫停，最多 14 天。
• 預付正價 12 個月會員會籍 – 一次暫停，最多 30 天。
• 申請暫停需至少 7 天發送電子郵件至 info@flexfitnessmacau.com 或微信：flexfitnessmacau 或 Whatsapp 我們以書面通知。
• 過去的事件或之前發生的事件不適用於暫停。
• 暫停期間會員必須交（每月200澳門元暫停費）。
• 暫停會籍必須需要提供暫停期間，成功申請暫停會籍不能再改/加/延期日期。
• 當您的會員會籍暫停時，您無法使用所有 Flex 的任何設施。 您可以選擇提前更改會籍開始日期。

•  延長會員會籍僅適用於以下情況：新冠疫情封鎖或類似情況、個人受傷或意外、醫療傷害或相關、懷孕。
• 只有預付正價會員會籍（一、三、六、十二個月）才有資格延長會員會籍。 每次延長會籍又最少七日至最長九個月延長期。FLEX FITNESS 保留其權利。
• 您必須提供醫院或診所或私人醫生的證明文件，證明您在延長期內無法使用FLEX設施。
• FLEX FITNESS 保留根據您的醫療證明或文件被視為無效的類型而拒絕您延長的權利。
• 其他優惠會籍 (任何形式的折扣或優惠價格，非正價) 將不會獲得於場所暫停開放的日子之延長會籍時間。折扣會員會籍、非正價會員會籍不享有懷孕會籍延長資格。
• 正價 1 個月會員會籍資格的免費醫療延長 - 僅限一次，最多延長 7 天。
• 正價 3 個月會員會籍資格的免費醫療延長 - 僅限一次，最多延長 14 天。
• 正價 6 個月會員會籍資格的免費醫療延長 - 僅限一次，最多延長 30 天。
• 正價 12 個月會員會籍資格的免費醫療延長 - 僅限一次，最多延長 60 天。
• 免費懷孕延長一次，最多九個月
• 如需加長延長醫療日期，每月需支付     200 澳門元

• 在自動轉帳會籍下，會員可申請暫停會籍：
• 每份合約，自動轉帳會員會籍可暫停兩次，每次最多三十天。
• 在不少於七天的書面通知 (info@flexfitnessmacau.com)，電郵，微信，WhatsApp 均可。
• 過去的活動不符合資格。
• 醫療事故可申請免費暫停最長九個月，只能申請一次，需要提供醫生證明。
• 如果任何自動轉帳會籍資格被暫停：
• 每月暫停手續費澳門幣 200元。
• 會籍的當前期限將相應地自動延後至暫停期。
• 在暫停期內，會員不能終止合同，也不能享受我們所有設施和服務。

  These terms and conditions (these “T&C”) govern the access and use of FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, also known as FLEX FITNESS. Any person (as Applicant, Subscriber, Member) who complete or completed an application form to FLEX, registered as a Member and use of any of the FLEX Clubs, shall be deemed to have accepted and agreed to observe and be bound by these T&C.

• All signed and paid memberships (1 month, 3 months, 6 months, 12 months membership, Flex Training, promotional memberships, or otherwise) are not refundable or transferable or in exchange for other services.

•  It is FLEX FITNESS terms and conditions that only individuals specifically employed as a (Personal Trainer, Trainer, Coach, Instructor, or otherwise) by FLEX FITNESS are permitted to      perform any type of (personal training, instructional training or otherwise), this includes one-on-one training, partner training, or small or large group trainings.
• Any individual not currently employed by FLEX FITNESS  as a (Personal Trainer, Trainer, Coach, Instructor, Freelancer, or  otherwise) who is observed to be providing (unauthorized personal      training, instruction services, or otherwise) to another individual or member in the facility will have his or her membership terminated. (A friendly “one time” warning will be given).

• Providing frequent equipment selection and adjustments for another individual or member.
• Writing or designing workout programs for another individual or member. 
• Frequently explaining and providing exercise techniques or corrections for another individual or member. 
• Guiding or following an individual or member around the facility and telling him or her what exercises to perform or how to do so. 
• Receiving compensation or personal gain of any kind for assisting another individual with his or her workout.

• FLEX FITNESS cannot adequately control the quality of personal training, instruction from individuals who are not employed by FLEX FITNESS. 
• These individuals may not have an adequate academic background, ability, training, knowledge, or experience to correctly train clients, which may put facility participants at risk of injury. 
• Individuals not employed by FLEX FITNESS have not been trained by staff with regard to facility policies, rules, guidelines, procedures, or standards, and therefore are unauthorized trainers.

• Every member must check in at the reception desk with their own member app.
• You are not allowed to borrow your member account to  any members, non-members, or any individuals, for the use of our facility  and services. This will result in a warning from our club and violates our  T&C. If recurring events happen, FLEX FITNESS has the right to  terminate your membership without notice.
• Expired memberships are to be renewed before using the  facilities.
• You are required to check in with your member app at  all times, but if you forget your member app, you can access the fitness club by showing an original driver's license, Macau ID, Picture Name Card, or passport.
• Please renew your membership in advanced 3-7 days to  avoid not able to use the facility during non-staff hours (12 am to 8 am)
• You can only renew your membership during staff hours  (8 am to 11:59 pm)
• All Flex members are required to use GYMMASTER blue tooth  check-in before entering the facility during non-staff hours (12 am to 8  am)
• If you bring a friend who is NOT a member into the facility during non-staff hours (12 am to 8 am) we will cancel your membership without any notice.
• You cannot lend your member account for another person to use all flex facilities, we will cancel your membership if this incident occurs.

• FLEX FITNESS requires you to bring your own towel for personal hygiene and to protect other members' interest in using the club facility.
• Please wear proper sports attire during all workouts, no sandals, open shoes, or slippers in the club.

• All minors need the financial guaranty of a parent or guardian and the parent or guardian must sign the membership agreement.
• Minors Ages below 17: May use FLEX facilities without being accompanied by a parent or guardian if the minor’s parent signs, pays and agree all T&C.
• FLEX FITNESS reserves the right, in its discretion to require that a parent or guardian accompany a minor.

• The subscriber or member waives and releases FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, its successors, presidents, vice presidents, employees, and agents harmless from all claims which may be brought against them by the undersigned for any injuries or claims or death, and does hereby forever release and discharge FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, its successors, presidents, vice presidents, employees and agents from all claims, demands, injuries, damages, actions, losses and expenses.
• There are natural hazards and risks connected with physical fitness, and weight training, and the member shall be solely and fully responsible for all such hazards and risks and all their consequences;
• Exercise or use of fitness equipment improperly or beyond one's physical and mental limits and/or accidents involving exercise equipment may result in serious injury or even death; and
• FLEX facilities are operated on self-serving basis (during 12 am to 8 am) and will generally open without any onsite staff, the member shall at all times solely and fully responsible for their own safety and wellbeing and that of other members.

•   Only prepaid standard pricing memberships (3, 6, 12      months) are entitled to membership freeze. Other memberships such as (promotion memberships, discount memberships, memberships that are not standard price)  are not entitled for freeze for any reasons.
• Subject to approval by FLEX FITNESS at its sole and absolute discretion.
• Members can freeze their memberships under the following conditions as below:
• Leaving Macau for a short period, vacation or holidays (flight itinerary is required for proof)
• > Prepaid standard price 3 months membership– one time freeze up to maximum 7 days.
• > Prepaid standard price 6 months membership– one time freeze up to maximum 14 days.
• > Prepaid standard price 12 months membership– one time freeze up to maximum 30 days.
• Applying for freeze is made by not less than 7 days written notice by sending us an email to info@flexfitnessmacau.com or wechat: flexfitnessmacau or whatsapp us.
• Past events or an event happened previously does not apply for freeze.
• Member shall pay administrative fees of (200 MOP per freeze) throughout the freeze period.
• Freezing of membership can be processed when a resume date is provided, you cannot change your resume date once it is applied, so please check carefully before you apply
• While your membership is frozen, you cannot access any of Flex club facilities. You have the options to unfreeze your membership early.

• Extended membership freeze only applies to the following: Covid lockdown or similar, personal injury or accident, medical injury or related, pregnancy.
• Only prepaid standard pricing memberships (1, 3, 6, 12 months) are entitled to extended membership freeze. Your membership may be placed on an extended membership freeze from minimum 7 days to maximum 9 months under certain circumstances, at Flex’s discretion, free of charge for one time (1). To qualify for extended membership freeze;
• you must provide a hospital or clinic or private doctor’s supporting documents stating you are NOT able to use the facilities during your freeze period.
• FLEX FITNESS reserves the right to reject your freeze depending upon the type of your medical certificate or document(s) is deemed invalid.
• Promotion memberships, discount memberships, memberships that are not standard pricing are not entitled for pregnancy membership freeze.
• > Free Medical freeze for prepaid 1 month membership - ONE TIME only, FREEZE up to maximum 7 days.
• > Free Medical freeze for prepaid 3 months membership - ONE TIME only, FREEZE up to maximum 14 days.
• > Free Medical freeze for prepaid 6 months membership - ONE TIME only, FREEZE up to maximum 30 days.
• > Free Medical freeze for prepaid 12 months membership - ONE TIME only, FREEZE up to maximum 60 days.
• > Free Pregnancy freezeone time only up to maximum 9 months
• > If required extra length of medical freeze period, will be charged at 200 MOP per month.

• Under autopay membership, the subscriber is eligible to apply for a membership freeze.
• Autopay membership is allowed to freeze for total two times, maximum 30 days per freeze, per contract.
• Made by not less than (7) seven days written notice by email, wechat, or whatsapp from the date of freeze starts.
• Past events are not eligible
• An administrative fee charge of 200 MOP per freeze.
• Extended medical freeze is eligible to apply (9) months maximum, provided with doctor's supporting documents of injury or cause.
• Extended medical freeze is allowed to use only one time per contract.
•  If any autopay membership is frozen:
• the subscriber shall pay Flex Fitness Macau administrative fees of MOP 200 per month throughout the frozen period
• the current term of the membership subscription shall be automatically postponed by the freeze period accordingly
• during the freeze period, the member cannot terminate the contract, or enjoy any benefits of the subscription, including  accessing all of our facilities and services.

• All FLEX training sessions shall be 60 minutes in length unless otherwise stated and must be paid in advance.
• All FLEX training sessions must be booked in advance.
• If you book up to three consecutive sessions or more with no show attendance, your fourth booked session and above will not be charged until our manager investigates the issue, if you have any concerns, please contact our manager.
• All FLEX training sessions are non-transferable.
• A late arrival for training will result in the session being shortened by an equivalent amount of time.
• If you arrived late for your booked sessions for more than 30 minutes, your training will be charged automatically with no refund.
• Your trainer may choose to stop a session if he or she feels you should not continue for any reason.
• There will be no refund for any unused or expired training sessions unless the reason is supported by a doctor's certified letter indicating that physical activity must be terminated. With      supporting documents, a full refund will be given on any unused training      session(s).
• For certain medical injuries or pregnancy, a credit will be given to the client and will be held a maximum of 12 months, after which the client will forfeit his or her training sessions.
• FLEX FITNESS reserves the right to assign a different trainer for any reasons.
• You require an active membership to book and use our  FLEX training service.

• All training is pre-arranged on a scheduled appointment basis. In order for effective use of time, all clients are asked to give a 12- 24 hours notice when canceling an appointment.
• This means a cancellation should be made at least 12 hours before the scheduled appointment by calling or texting your trainer  directly or contact our receptionist.
• Training sessions canceled less than 12 hours of the scheduled appointment will be billed a single session and deducted from your account.
• If you call the day of your scheduled session to  reschedule, that session will be charged.
