這些所有的條款細則(以下簡稱“條款和細則”)約束於 FLEX FITNESS (菲力斯體育會,菲力斯健身會,菲力斯健美運動協會, 設施的到訪和使用,任何人(申請人,會員,訂戶或其他人)向 FLEX FITNESS 完成並提交申請,訂閱,入會,到訪或使用任何FLEX FITNESS 的設施,均視為已接受並同意遵守且受其條款和細則約束。
棄權和責任
- 所有會員放棄並免除 菲力斯體育會,菲力斯健身會,菲力斯健美運動協會、其繼任者、會長、副會長、員工和代理人免受以下簽署人可能因任何傷害而向他們提出的所有索賠要求或索賠或死亡,並特此永遠免除 菲力斯體育會,菲力斯健身會,菲力斯健美運動協會及其繼任者、會長、副會長、員工和代理人的所有索賠、要求、傷害、損害、訴訟、損失和責任花費。
- 存在與身體健康和舉重訓練相關的自然危害和風險,會員應對所有此類危害和風險及其所有後果承擔全部責任;
- 運動或使用健身器材不當或超出身體和精神極限和/或涉及健身器材的事故可能導致嚴重傷害甚至死亡; 和
- 由於 FLEX 設施以自助方式運作(晚上 12 點至早上 8 點),並且通常在沒有任何現場工作人員的情況下開放,因此會員應始終對自己以及其他會員的安全和福祉承擔全部責任。
1.1 必須使用會員應用程式簽到(或於員工工作時間出示身份證明文件)。
1.2 嚴格禁止共享帳戶:違者將終止會籍。
1.3 非員工工作時段(凌晨12時至早上8時):
- 必須使用藍牙簽到。
- 必須使用人臉識別簽到。
- 禁止攜帶訪客進入。
2.1 僅限穿著合適運動服裝(禁止牛仔褲/涼鞋)。
2.2 請自備毛巾。
3.1 未滿17歲人士需由家長/監護人簽署合約。
3.2 FLEX有權要求未成年人由家長陪同使用設施。
4.1 會員於簽約後7天冷靜期內可取消會籍並獲全額退款(扣除已使用服務價值)。
4.2 退款金額 = 已付總額 -(已使用天數 ÷ 合約總天數 × 總費用)。
4.3 冷靜期過後,所有費用概不退還、不可轉換或轉讓。
4.4 優惠會籍可能設有附加限制。
5.1 只有FLEX正式聘用的教練(私人教練、導師等)方可進行任何形式的指導(包括一對一、小組訓練等)。
5.2 任何非FLEX聘用人員若被發現在場地內提供訓練服務,其會籍將被終止(首次違規將獲一次口頭警告)。
6.1 頻繁為他人選擇或調整器材。
6.2 為他人設計訓練計劃。
6.3 頻繁指導他人運動技巧。
6.4 帶領他人進行訓練或告知其如何操作。
6.5 因指導他人而獲取任何形式報酬。
7.1 基於品質管控、法律責任及安全考量。
8.1 僅限標準會籍(不包含優惠會籍):
- 3個月會籍:最多凍結7天
- 6個月會籍:最多凍結14天
- 12個月會籍:最多凍結30天
8.2 每次凍結收取**200澳門元手續費**(醫療/懷孕原因除外)。
8.3 需提前7天透過電郵/微信提交書面申請。
8.4 申請凍結需發送電郵至 info@flexfitnessmacau.com 或微信聯絡 flexfitnessmacau。
8.5 已發生的事件不符合凍結資格。
8.6 凍結期間每月需支付200澳門元行政費。
8.7 申請時需提供恢復日期且不可更改,請謹慎填寫。
8.8 凍結期間無法使用任何設施,但可提前申請解凍。
9.1 需提供**醫生證明**:
- 1個月會籍:最多7天
- 3個月會籍:最多14天
- 6個月會籍:最多30天
- 12個月會籍:最多60天
- 懷孕:最多9個月
9.2 超出額度後,每月收取200澳門元費用。
10.1 除颱風8號等極端天氣外,所有會所全年365天24小時開放。FLEX有權隨時關閉會所或限制會員進入,且無需提前通知或賠償。
10.2 非員工工作時段為自助服務模式,會員需自行維護設施整潔。
10.3 FLEX可隨時調整設施開放時間及細節,恕不另行通知。
10.4 FLEX保留遷移或永久關閉會所的權利。
11.1 自動付款會員可申請凍結會籍。
11.2 每份合約可凍結2次,每次最多30天。
11.3 需提前7天透過電郵/微信提交書面申請。
11.4 已發生的事件不符合凍結資格。
11.5 每次凍結收取200澳門元手續費。
11.6 醫療原因最長可延期凍結9個月(需醫生證明)。
11.7 每份合約僅限一次醫療延期凍結。
11.8 凍結期間:
- 每月需支付200澳門元行政費
- 會籍期限自動順延
- 不可終止合約或使用任何設施
12.1 所有課程需預付費,每節60分鐘。
12.2 需提前預約課程。
12.3 連續3次缺席未通知者,後續課程將暫停預約直至調查完成。
12.4 課程不可轉讓。
12.5 遲到將縮短課程時間。
12.6 遲到超過30分鐘視作已使用課程。
12.7 教練有權因安全理由中止課程。
12.8 未使用課程恕不退費(持有醫生證明者除外)。
12.9 醫療/懷孕原因可保留課程信用額12個月。
12.10 FLEX有權更換教練。
12.11 需持有有效會籍方可預約課程。
13.1 所有課程為預約制。
13.2 取消需提前12-24小時直接聯繫教練或前台。
13.3 未提前12小時取消者將扣除當節費用。
13.4 當日更改預約時間視作已使用課程。
These terms and conditions (these “T&C”) govern the access and use of FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, also known as FLEX FITNESS. Any person (as Applicant, Subscriber, Member) who complete or completed an application form to FLEX, registered as a Member and use of any of the FLEX Clubs, shall be deemed to have accepted and agreed to observe and be bound by these T&C.
Waiver and Liabilities
- The subscriber or member waives and releases FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, its successors, presidents, vice presidents, employees, and agents harmless from all claims which may be brought against them by the undersigned for any injuries or claims or death, and does hereby forever release and discharge FLEX SPORTS CLUB, FLEX FITNESS CLUB, FLEX BODYBUILDING SPORTS CLUB, its successors, presidents, vice presidents, employees and agents from all claims, demands, injuries, damages, actions, losses and expenses.
- There are natural hazards and risks connected with physical fitness, and weight training, and the member shall be solely and fully responsible for all such hazards and risks and all their consequences;
- Exercise or use of fitness equipment improperly or beyond one's physical and mental limits and/or accidents involving exercise equipment may result in serious injury or even death; and
- FLEX facilities are operated on self-serving basis (during 12 am to 8 am) and will generally open without any onsite staff, the member shall at all times solely and fully responsible for their own safety and well-being and that of other members.
1.1 Mandatory check-in via member app (or ID during staff hours).
1.2 Strict no-sharing policy: Account sharing results in termination.
1.3 Non-staff hours (12AM-8AM)
- Bluetooth check-in required.
- Facial recognition check-in required.
- No guest access permitted.
2.1 Proper athletic attire only (no jeans/sandals).
2.2 Bring your own towel.
3.1 Minors <17 require parent/guardian signature on contract.
3.2 FLEX may require parental accompaniment at its discretion.
4.1 Members have a 7-day cooling-off period from contract signing to cancel for a full refund (minus value of services used).
4.2 Refund = Total paid - (days used ÷ contract days × total fee).
4.3 After the cooling-off period, all fees are non-refundable, non-exchangeable, and non-transferable.
4.4 Promotional memberships may have additional restrictions.
5.1 It is FLEX FITNESS terms and conditions that only individuals specifically employed as a (Personal Trainer, Trainer, Coach, Instructor, or otherwise) by FLEX FITNESS are permitted to perform any type of (personal training, instructional training or otherwise), this includes one-on-one training, partner training, or small or large group trainings.
5.2 Any individual not currently employed by FLEX FITNESS as a (Personal Trainer, Trainer, Coach, Instructor, Freelancer, or otherwise) who is observed to be providing (unauthorized personal training, instruction services, or otherwise) to another individual or member in the facility will have his or her membership terminated. (A friendly "one time" warning will be given).
6.1 Providing frequent equipment selection and adjustments for another individual or member.
6.2 Writing or designing workout programs for another individual or member.
6.3 Frequently explaining and providing exercise techniques or corrections for another individual or member.
6.4 Guiding or following an individual or member around the facility and telling him or her what exercises to perform or how to do so.
6.5 Receiving compensation or personal gain of any kind for assisting another individual with his or her workout.
7.1 Quality control, liability, and safety considerations.
8.1 Standard memberships only (excludes promotions):
- 3-month: 7-day freeze
- 6-month: 14-day freeze
- 12-month: 30-day freeze
8.2 **MOP 200 fee per freeze** (except medical/pregnancy).
8.3 Requires **7-day advance notice** via email/WeChat.
8.4 Applying for freeze is made by not less than 7 days written notice by sending us an email to info@flexfitnessmacau.com or wechat: flexfitnessmacau or whatsapp us.
8.5 Past events or an event happened previously does not apply for freeze.
8.6 Member shall pay administrative fees of (200 MOP per freeze) throughout the freeze period.
8.7 Freezing of membership can be processed when a resume date is provided, you cannot change your resume date once it is applied, so please check carefully before you apply
8.8 While your membership is frozen, you cannot access any of Flex club facilities. You have the options to unfreeze your membership early.
9.1 Requires **doctor's documentation**:
- 1-month: 7 days max
- 3-month: 14 days max
- 6-month: 30 days max
- 12-month: 60 days max
- Pregnancy: 9 months max
9.2 Additional months: MOP 200/month after allowance.
10.1 All Flex Clubs are generally opened throughout the year for 365 days, 24 hours, excluding public holidays and during severe weather such as typhoon 8 or other warnings. FLEX reserves its right to close any club locations, or decline access or use of any clubs and facilities to our members, at any times without prior notice or compensation for any reasons whatsoever.
10.2 All Flex Clubs operate on a self-service basis and are typically open without on-site staff, except during specific hours determined by Flex at its sole discretion for its convenience. Members are responsible for maintaining the cleanliness and orderliness of the Club and its facilities, ensuring they remain accessible and usable for all members.
10.3 All Flex Centers and Flex Facilities, including but not limited to their availability, operating hours, and any other related details, may be modified at any time at the sole and absolute discretion of Flex, without prior notice. Flex shall not be held liable to any members regarding the availability or condition of the Flex Centers and Flex Facilities.
10.4 Flex reserves the right to relocate or permanently close any Flex Clubs, Facilities or centres, at any time, without prior notice or compensation to its members.
11.1 Under autopay membership, the subscriber is eligible to apply for a membership freeze.
11.2 Autopay membership is allowed to freeze for total two times, maximum 30 days per freeze, per contract.
11.3 Made by not less than (7) seven days written notice by email, wechat, or whatsapp from the date of freeze starts.
11.4 Past events are not eligible
11.5 An administrative fee charge of 200 MOP per freeze.
11.6 Extended medical freeze is eligible to apply (9) months maximum, provided with doctor's supporting documents of injury or cause.
11.7 Extended medical freeze is allowed to use only one time per contract.
11.8 If any autopay membership is frozen:
- the subscriber shall pay Flex Fitness Macau administrative fees of MOP 200 per month throughout the frozen period
- the current term of the membership subscription shall be automatically postponed by the freeze period accordingly
- during the freeze period, the member cannot terminate the contract, or enjoy any benefits of the subscription, including accessing all of our facilities and services.
12.1 All FLEX training sessions shall be 60 minutes in length unless otherwise stated and must be paid in advance.
12.2 All FLEX training sessions must be booked in advance.
12.3 If you book up to three consecutive sessions or more with no show attendance, your fourth booked session and above will not be charged until our manager investigates the issue, if you have any concerns, please contact our manager.
12.4 All FLEX training sessions are non-transferable.
12.5 A late arrival for training will result in the session being shortened by an equivalent amount of time.
12.6 If you arrived late for your booked sessions for more than 30 minutes, your training will be charged automatically with no refund.
12.7 Your trainer may choose to stop a session if he or she feels you should not continue for any reason.
12.8 There will be no refund for any unused or expired training sessions unless the reason is supported by a doctor's certified letter indicating that physical activity must be terminated. With supporting documents, a full refund will be given on any unused training session(s).
12.9 For certain medical injuries or pregnancy, a credit will be given to the client and will be held a maximum of 12 months, after which the client will forfeit his or her training sessions.
12.10 FLEX FITNESS reserves the right to assign a different trainer for any reasons.
12.11 You require an active membership to book and use our FLEX training service.
13.1 All training is pre-arranged on a scheduled appointment basis. In order for effective use of time, all clients are asked to give a 12- 24 hours notice when canceling an appointment.
13.2 This means a cancellation should be made at least 12 hours before the scheduled appointment by calling or texting your trainer directly or contact our receptionist.
13.3 Training sessions canceled less than 12 hours of the scheduled appointment will be billed a single session and deducted from your account.
13.4 If you call the day of your scheduled session to reschedule, that session will be charged.
